I think that you should be fine. You can definitely file two H1-B visa applications from two different companies. The companies can only ask you to pay back the attorney fee. USCIS rules stipulate that they cannot ask you to return the H1-B filing fees. As far as legal disputes are concerned, that will be according to the contract that you sign with the company. Most companies make it clear that the job offer is contingent on you receiving the H1 and that you have to pay back the legal fees ($1000 or so) if you break the contract.
