    I'm a bit confused between D and E.

I think the main problem with the original subclause lies in "...making it a crime punishable by imprisonment that a United States citizen hold gold.."
Those two words should be changed into "... making it a crime punishable by imprisonment for a United States citizen to hold gold.."
That makes A and B out.
C is incorrect since it makes the two clauses become parallel without adding the "connecting word" that will make them parallel such as "and", "or", etc.

E sounds better to me, so I choose E.

    prefer D

being is usually wrong more often than it is right.

pharmindo, the pattern for using "being" is

with + NOUN + being + NOUN Complement.

check http://home.comcast.net/~dave.kim/GM...y_Strategy.htm for more info on being.
