Can someone be so kind as to provide us with a breakdown of why the other answer choices are wrong?

X + that + noun + simple verb without to

Is this always the form of subjunctive? How do we spot the subjunctive mood?

Can some one explain what they refers to here? Is they not ambiguous?

I don't believe 'they' is ambiguous in this situation as it correctly refers to the closest noun (defendants)...although I could be wrong
