The author of this opinion is implying that the indictment on any individual for their unlawful act should be calibrated against the situation on which the act was committed and should vary from incident to incident. I am strongly discordant with this opinion. Crime cannot be measured taking into account circumstances. It is a known fact that we have separate laws pertaining to every kind of incident which is considered felony or unlawful act. The authority is responsible to investigate the crime and submit their result to the court and the case proceeds based on the investigation. There is panel of jury formed out of the citizens who may have no legal portfolio attached to them, in a word, common citizens who are selected on a random basis to evaluate a crime and give their predictions on a defendant. Thus indirectly or involuntarily we introduce flexibility in the outcome of a criminal charge. When evidences are submitted to the court the judge as well as the juries scrutinizes the case and dialogues with the defendant and the public prosecutor brings out the motive behind the crime. The juries unbiased then declare the defendant as guilty or not guilty purely considering the evidence and the circumstances under which the crime was committed. So in a way we are flexible or lenient in our law enforcement .Thus to make the law itself flexible is unnecessary , instead the uniformity of law should be maintained while the repercussions of breaking it is fine-tuned based on the circumstances. However it is to be bored in mind that the investigation should be carried with due-diligence and there shouldn’t be any gap or loophole in the findings. If a comprehensive and coherent investigation, supplemented with lawful truth from witnesses can be formed, no crime will escape the firm grasp of law and the deceit of the legal system is impossible. In spite of all this judgment, the law is not beyond fallacy and time and again we have seen it to bend unlawfully and unscrupulously, due to the lack of evidence or misjudgment .Thus to conclude I would like to point it out that every legal system has its limitations and miscreants have considerable propensity to break through its legal. Thus execution rather than formulation is important in any legal proceeding. |

It maintains the peace and transquility of the socity and turns the shape of polities, economic. The statement given here says that Laws should not be rigid or fixed, instead, they should be flexible enough to take account of various circumstances, times, and places ; but I am not agree with it. I think that Laws should be rigid and strictly followed to maintain peace in society. Enviormental problem is one of the biggest problem in the world. Everybody is taking action against the pollution. Reaschers are having international meetings, seminar and other actions to prevent it . Government also is taking different action on it, as industries should not be sitauted nearby the residental areas. All industries should have an ISO cetification to maintain the pollution. Automobile holders should maintain their EURO standards in their vehicle. If laws are not rigid or flexible. then we can’t contorl the problem of pollution. Keeping the enviorment problem in mind How should the rules be flexible enough to take account of various circumstances, times, and places. Due to the overpopulation , the China government makes a rule for all of the citizens that they must have only single child. if China government doesn’t make this strict law then they can’t control the poplulation. All of the citizens should follow this rule and there is no flexibility for it to any one. If they don’t follow it strictly , their may be serious problems of insufficient space, food and unemployment in the countary. Laws are made for human welfare and for civilaztion of the countary. If the people do not follow the rules and regulation of the country, the crime will increase day by day. For example, we have traffic rules which should be followed by every one strictly. if we have flexibilty in the traffic rules then any one can jump the traffic signals and can justify that he was in rush to catch his flight so he didn’t follow the rule. This kind of flexibilty in the rules could be very dangerous for daily transporation. Government have had made the rule that nobody can carries weapons or any kind of liquid stuff in aerolane. If this is not followed strictly then terrorist can misue the flexibiliy of the laws and regulations and can hyjack the plane. At last i would say that laws should be rigid and fixed to maintain the peace and transquility in the society and nation. |

This is my first try at Issues...

Laws were introduced into society as early as humans became cultured .And has become quite a quintessential need for the society to function with proper quorum.The very aspect of imposition of laws and abidance of rules and regulations calls for peace and harmony ,weeding out factors which would endanger the balance of civic life.However ,Any imposition of Law should not be a blind inconsiderate one,but should take into account the circumstance and substances and factors which triggered the action of a certain resentful act. Taking into account as to how Laws have functioned over the decades,It is quite evident that there has been a transcendal shift from the kind of Law where “An eye for an eye ,A tooth for a tooth” was practiced to the present scenario which is far more slackenin to the perpetrators.The cause for such a incidental shift and the reason as to why such a shift should prevail originated from the fact that the Society and Civic life of the general crowd has undergone a great tumult .People have become more cultured.Traces of barbarianism have vanished to specks.Moral value of an individual is placed High and Lofty .In other words,Incidence of crimes and the severity of the same have taken a mild tone.And any account of aberrant behaviour can be attributed to a stimulating atmosphere and unavoidable circumstances. Admittedly Any individual should be given a chance to present his plea . Circumstances which are unavoidable should be considerered for grant of pardon.This ensures that, defendants who are morally obliged but were made a bait by the vagaries of time would not be penalized severely. However habitual crime perpetrators should not be left scot free.Checks should be made to ensure that such criminals are given the highest degree of punishment that they deserve and that the flexibility of law do not apply to such people. On a note of conclusion ,It is incumbent to point out that,Laws are meant to ensure the proper peaceful functioning of the society ,by policing the guilty and by pardoning the innocent-turned-guilty.After all ,Innocent turned guilty is again a victim of circumstances. |
