My husband received the h1b documents from RiteAid from 2 days.He called the embassy to take the appiontment for visa stamping h1b and h4.But,the embassy requested that the wife's name should be added on the form I-797.I know that form I-797 is the approval notice and it doesnt contain any space to fill about the marital status or the wife's name.It 's very confusing and we really need help.If anybody in the same situation??or have passed through it before may give any advice???

There is no need for the spouse's name to be on the form I-797 to qualify for an H4. If there is proof of marriage between the principal applicant and the spouse, then there should be no problem.
I went for my visa interview today and it was very simple. I went together with my family and i was just asked about how I heard about the job and where I had my pharmacy education. He did not request for any other document apart from the approval notice and did not ask my wife any question. The visa officer asked me to come for our passports with the visas on Wednesday (in 2 days). The little problem i find worrying is the fact that my original form I-797 was not returned. I am not sure if it should have been returned to me or not. If anyone has any insight on this, please kindly shed some light so that I can request for it when I go for the visas. So pals, it is not too early to apply for visa stamping and the interview is not difficult so chill out. |

Great Thanks for your quick reply, this comforted be a little bit.
Congratualtions for your visa stamping and wish you the best always.About your I-797,I think you should call the embassy and ask them about it.At least you should keep a copy of it.Also, can I ask you another question in which country you did the visa stamping??As,we are from Egypt and I guess the situation differs here. |

Hi,
Maybe they might attach it to the passport, that's what they do with the i-20 when you apply for student visa, but we will come to know in few days time. Has anyone who is in the USA received the h1b visa documents by fedex from Rite Aid.? |

Hi lily , I have read your message and I would like to help You
I'm also from Egypt and I just recieved my stamped H1b visa from the embassy here in Cairo. You don't need your name appearing on the th I-797 to get the visa. all you need is your original marriage certificate. Don't worry about the person who answered you on the phone. They are not pretty much aware of the actual procedures for H1 and H4 stamping. They also told me to have my wifes name endorsed on the I-797 . I was quit confused about it but just didn't have time to do anything and it wasn't a problem at all. The counsler interviewing you would only need your marriage certificate (original). The interview was so simple. Just a couple of questions about the sponsering company, previous visits to the US and previous extensions of stay in the US. and thats it. If you have anymore questions just reply me. Hope you the best of luck |

Thanks mocharody,this was very helpful
congratulations.Hope everything will be fine.we are afraid really ,as my husband got f1 visa rejected last year. plus, there is a mistake in the spelling of the middle name in form I 797 and rite aid didn't correct it saying it will cost them 2000 us dollars because it was their fault. They said a mistake in the middle name isnot important at all .HOPE EVERYHTHING WILL PASS PEACEFULLY .
