It is perfectly legal to file another H1B, provided you submit a copy of your previous H1B receipt. So that, you will not be counted again. Also, if you have more than one h1B from different chains, its the company with whom you start from October 1st is considered as your employer. Thereafter, if you want to transfer, you can do so only by using the current employer's H1B. The other employer with whom you are not reporting has to cancel your H1b with the USCIS.
NB: This is possible only if you have more than one H1B before october 1st. |

Hi rivaldo,
I totally agree with you with regards to Walgreens, they are very strict with their documentation and they do not do h1b transfers of interns only registered pharmacist.Other chains do sometimes, I know this because a friend of mine got a transfer done without starting work with the company that filed the H1b,but then there can be exceptions and this happened last year. |

Hi Laura.pharm,
When you are looking for jobs you do not apply at only one place and hope to be selected, you apply to a few places and hope that you will get selected in one or 2 out of 5 or 10 applications you send.Each organization takes it own sweet time to respond to you,some are faster, some might be slower to inform you and others in the last minute that they have filed for your h1b. As we are desperately looking of an sponsor we accept the first one that comes in hand. If lets say that coincidentally the slower processing company informs you in the end that they have also filed your h1b and send the documents to USCIS, how does that hold with the statement of rite aid mention that if some else has applied for you. It is time, when rite asked has anyone else applied for your h1 at that time the answer would be no, but then afterwards you come know that on the last day (31 March) that this other company has also applied for h1b. Rite Aid send out emails as to where you will be located who will be your district manager and why not meet him before hand or email/phone to ask about your leave and explain the situation to the pharmacy manager.Or maybe when you start work you can ask him, I guess that will be better.
