does anyone know whether a H1B is counted among the 35000 already issued if a company has filed for H1B but not got a reply from USIS yet??

or do they only deduct ones H1B when they approve it??

Hi pharmajay,

Once H1 petition reaches USCIS then u don't need to worry about cap becos they count that one also in the count irrespective of whether they approved it or not.Anyway they will issue receipt note after few days.
