USCIS expects that there will be more h1b applicants than visas available for the fiscal year 2009(like last year or worse). They will accept petitions from April 1 to 7, then reject petitions after this date. There will be a random lottery. So pray for us.For more info. please proceed to USCIS Home Page.

Calm down! I was one of those who missed out H-1B quota last year. There is always another option to go.
It might not be as bad as everyone expected. This year, new rules have been applied. Those who send out many applications in the same time will have trouble. INS has hints to investigate fraud H-1B. Last year, some companies have been caught by INS. Believe in this logic: In this economic situation, do you believe that there are over 65,000+20,000 job offers? That is something to think about. Hold on! God have planned for us. Good luck. ![]() Knok

Hello mirozoza,
I do got offer from 2 different companies but I withdrawn one recently because I am not sure of these changes. I approached couple of lawyers each one has their own opinions. So I am not sure about what they said thats why I withdrew one application. For more information please check this link: H1BCapInfo.com: H-1B Cap Blog from Ellis Porter - The Immigration Attorneys - Last edited by knok : 03-31-2008 at 06:21 PM. Reason: plz, i |

Also, if your two applications are selected, you may be obligated to pay back a company which can sue you for their losing opportunity to hire you. Check Murthy forum for this answer. I read some information from that web site.

Yes, you are correct. For me, dealing with a company who will sue you since you do not work for them after receiving H-1B may be bad. Company can sue you for losing H-1B fee and opportunity. The latter may cost a lot more than H-1B fee.

I think that you should be fine. You can definitely file two H1-B visa applications from two different companies. The companies can only ask you to pay back the attorney fee. USCIS rules stipulate that they cannot ask you to return the H1-B filing fees. As far as legal disputes are concerned, that will be according to the contract that you sign with the company. Most companies make it clear that the job offer is contingent on you receiving the H1 and that you have to pay back the legal fees ($1000 or so) if you break the contract.

Hi everyone,
If you file two applications or more, please tell us what is going on with your situation after that. We want to know. Please read this carefully. Please read all links from USCIS in this thread: Multiple H1b Applications and lottery system - Topic Powered by Infopop Multiple Applications = Invitation to RFE ... Read Why - Topic Powered by Infopop However, no matter what you do, please think about the image of H-1B applicants who are and will be sponsored in the future. Many companies do not want to sponsor because the hassle of H-1B. If the trouble is caused from INS or government regulations about the number of quota, it is another issue but please do not make employers so freak out that they don't want to sponsor foreign pharmacists anymore because you are not playing a fair game. Good luck. Thanks. Knok
