Clarification about multiple H1B petitions

Hi all,
I was reading the posts by Knok and others.I believe it's better to read official website(USCIS) than any other forums because these forums may not contain correct information.

USCIS allows two petitions by two different companies and if selected petition will be counted only once. USCIS will select the company and reject the second one.

Secondly RFE(request for evidence) will be asked if a parent company and it's subsidiary applies for the same individual for same or different post.

Now these information are provided in the official USCIS website.How to get there 1) USCIS Home Page . Paste this id in address bar
2) On the page Under click on 2nd one USCIS Announces Interim Rule on H-1B Filings
3)On the right side there is Click on Interim Final Rule on Duplicate H-1B Petitions (141KB PDF) or if you can click on this link,it's enough.

It's a 27 page document.Read carefully word by word.I took print out and read at least 4 or 5 times.
Now, what i said earlier is mentioned in pages 9,10,14,15,16,17,18.

To conclude,i am not against any ethics and i am not encouraging anyone to
file 2 petitions.But some of my friends who are IT professionals are applying through 2 different companies to get a better chance of selection in lottery.

We, pharmacists after going through all these exams and hard work(especially to pass toefl ibt) will be again left out in the lottery selection.
On the other hand,IT professionals are playing smart and also they don't have to have undergo all these exams (not even language exam as like in UK now).

So guys and gals it's all depends on luck and WHO PLAYS SMART.

Hi jopaul! I agree with you, but where did you read that if there are more than 1 petition (from different employers) and your name gets selected, the USCIS will select 1 and reject the other petition? I read the document too, and I did not see anything specific about this.

Good luck to all of us waiting for our H1b visas!!!

Jopaul,

I agree with you. Please read USCIS web site carefully. If you can summarize it here, that would be perfect. We don't need to jeopardize our hard work by playing against USCIS rules either. I could not find that page. That's why I posted the link to that forum. Many people are using that forum and it is usually reliable from time to time but I don't know about it this time. The owner of the forum is a lawyer. I just want to warn people to get the correct information and analyze the situation.
