I beleive Kim said till the end of June just not to continue asking them after June,the 2nd.Every thing will be clear by around the first weak of June.So,every day passes reduces the hope,we have about 10 other days of this lovely waiting!If nobody have heard about any rejections yet,so it is true that they send rejections at last.on the other hand,the odds,I beleive, are still 45% because any miniute we may receive the very long time waited email!Any way,we have nothing to do!we did our part by passing the two hard exams,especially the miraculeous passing of IBToefl ,and the rest is all in the hands of God.I suggest to start a course of xanax,this will be much helpfull.

05/22/2008: Fading Hope for FY 2009 H-1B Cap Lottery Filers
  • As we all know it, the USCIS announced that they had received about 163,000 H-1B cap petitions between April 1 and April 7, 2008. The computer random lottery selection process was completed by April 14, 2008. Since then they have been sending out receipt notices to the lottery winners including U.S. master degree holders. The number of winners would include approximately 58,000 regular cap cases plus a very small number of Singapore/Chile Free Trade H-1B1 cap cases plus 20,000 U.S. advance degree holders. Accordingly, approximately one-half of 163,000 or 80,000+ winners must have been receiving the receipt notices in the mail. The USCIS stated that all the receipt notices for the winners would be sent out by June 2, 2008. Considering the fact that we are approaching the Memorial holiday long weekend plus another weekend before June 2, 2008, Monday, there are only a few working days ahead of us and we can safely speculate that most of the receipt notices have been mailed out to the winners by now. Consequently, unless they have already received the notices, the chances for their lottery selection may be very slim and their hope for the selection is gradually fading away.
  • It is likely that immediately after June 2, 2008, the losers (approximately 80,000) may start receiving mails from either California Service Center or Vermont Service Center. The first type of mail will include notices that they have failed in the selection but their cases have been selected for the waiting list. These waiting list will be prepared using the estimate potential denials or withdrawals or revocations of the lottery winner cases (traditionally approximately from 10% to 15%) plus the Singapore-Chile Free Trade number left-overs. The pool and waiting list notification may include more numbers than these estimates for the obvious reasons. The exact number of the cases in the waiting list pool is at this point anybody's guess. But these numbers are likely announced by the agency sometime in the middle or late June 2008 at the earliest. The second type of mails the people will receive in the mail after June 2, 2008 include return of the petitions that failed in the lottery selection. Accordingly a large number of employers will receive thick and heavy brown envelopes in the mail. The agency plans to complete such mailing by approximately July 15 or August 2008.
  • The circus will then be over until April 1, 2009 unless the Congress passes one of the pending H-1B cap readjustment bills in the Congress. Unfortunately, these bills face some obstacles amidst the battle between the high-tech industry and the farm or food product processing industry, the former supporting the piecemeal immigration fix legislation mostly by the Republicans aligned with the big businesses and the latter supporting the comprehensive immigration fix legislation mostly by the Hispanics and the Democrats aligned with the farm and food processing industry and labor unions. For now, circus is over, and just as people feel at the close of circus, people start feeling emotional vacuum and emptiness followed by some sadness and frightening silence. Pharma king are you sure from this information you posted above...do they really finally send the rejection emails for the unfortunate guys at last?IF so ,then ,why Kim Miller kept saying during the last period to all people who tried to contact them....that they haven't recieve any rejections yet.....didn't they know how the system works and tell the truth from the beginning that rejections will be all accumulated to be sent at last.... or they were anathesing our pain...I don't know...I HOPE WILL ALL GET RELIEVED SOON.

Hi Lily,
It seems to be like that.This article was originally posted on the immigration-law.com which is a specialized law firm.I hope they are wrong.But we have not heard about any rejections yet,which means that they come last,have you?I think Kim said that just to make us not to call her,specially that she received a lot of calls and emails lately.and also every thing will be clear by the end of june,they will receive the rejections and the notes of the waiting-listed.don't forget that there is a very slim chance in the next three days,till the end of friday working hours unlessa new legislation is made by the congress which may increase the number,but this seems unlikely.I don't want to frustrate you,but I am also looking for any news give me some hope.

I have heard some attornyes told their applicants that USCIS postponded it till 7th of June.Still maybe there is some hope.

Hello Guys. I was also sponsored by Riteaid and my petition was selected in the random selection process. I just checked my status and status is showing approved. My batch number #145 and my assigned area#Ohio.

Now I was wondering to know that when I will get my approval papers from the Riteaid. I have heard that they usually send the approval notice together.Anyone who has some information about that , please let me know. Finally , I would like to thanks in this forum for their useful information and support.

06/12/2008: FY 2009 H-1B Cap Processing Update
  • The USCIS has kept its origital schedule to mail out receipt notices for selected cases before June 2, 2008. According to the AILA, they indeed completed mailing out of the receipt notices on May 24, 2008. They started returning the loser cases beginning from this week. One bad news is that there will be no "reserve pool" this year as they determined that the initially selected cases meet this year's cap without the reserve.

Pharma King, are u sure of above information of no "reserve pool". Do you mean reserve pool as waiting list or are they different?

Hi,
My case was filed in California service center under normal processing. I still did not get any status about my appl. Has they started to sent the rejected applications? Does it mean that I have not made thru the lottery as I did not hear anything still? Can I still be optimistic abt the visa?

Yes, you can still be optimistic about the application because if rejection letters has been posted in May as some claimed, then Kim should have gotten them by last week and informed us. AM still hopeful!!!
