Deferal and reapplying in better schools

I have a funded phd offer from an average ranked((50-60) US school. I got it while doing a masters there and accepted the offer as the funding was adequate. But for some technical problem i can not continue Phd this year.So, i have requested the school to defer my admission till next year. The school were disappointed but agreed to keep the offer till 2009. Now, is it ok if i apply to some other economics phd programs this winter? I mean if it is against the law or rules? If it is against the law, i wont apply. Please help me decide.

In my opinion, no. I think you should either cancel the deferral (and perhaps reapply to this school and other schools), or should plan on accepting their offer.

I would say yes if it wasnt with aid. If it is with aid, I dont know. You may want to actually discuss this with the dept (although I could understand why you may be nervous to do so).

not necessarily. It would depend on when he lets the department know he is not coming. If he tells them early enough (i.e. before April 15) they will be still able to offer the place to somebody else.

Of course it's not against the law. It may be unethical, but I tend not to think so, for the reason mentioned by veroniquaz. It's your own life, after all. The only thing that can happen legally is that you lose your fee deposit, in case you paid one.

What I don't understand, however, is how on Earth you'll manage to obtain LORs from that school: it would be very strange if not at least 2/3 LORs where from your master's program. I doubt anyone at the department would help you applying to other schools unless you gave up your offer at their school.

Do whatever you think is better for you! The benefit you will get by studying in a better programme will be much higher than your department's loss. Schools know that people may change their minds and that is why there is something called "waiting list".
