It's really last... :o

1) Is the "same" should be with the all the time. why?

- I have the same book as you have.
- He always gives the same old excuse.

2)"books of the same size" is common usage. why not "the same size of the books"

Firstly, I think these "the" are not for "same" ,but for the nouns followed.

Secondly, we can use "same" without "the" in some case.
e.g. -Happy new year!
-Same to you!

"Books of the same size" emphasizes the books. And those books happen to be the same size.

"The same size of the books" emphasizes the size.
