Hi!. I write you because the same thing happen to me. Except that the us counsul cancel also my turist visa, saying that I spend to much time in US ( i was there almost 6 moths, because my my i94 said that i cand stay there all that time)so, that mean that i have insufficient bonds to return to my country. Now, i planning to re-appling again for my f1 visa but i want to do it in about 5 or 6 months. What do you think it's a good waiting time??? How can i proof that i have enough bonds to return my country ??

Yeah, wait 6 months to 1 year.
Warning (once again) to all. B visa holders usually get 6 months max per stay in the USA..... BUT that does not mean you can stay 6 months with no consequences!! Think about it... who needs 6 months to be a tourist? The govt point is they give you 6 months just to be nice/sure: no one will need 6 months to be a tourist, but just to give u room. So if u return to your country and apply for a non-immigrant visa (F J M) after staying the max 6 months on a B, you will probably be denied. It happens all the time. Tino

Dear Tino and other members who could help me,
I have to go back to my country after taking the Naplex. I have to come back soon to take MPJE. What are the chances that I would be denied entry to the US for a short gap like within a month or so (because authorization for the test is going to expire for a couple of month)? My profile is following. I had applied a B-2 visa once because I was going to attend a conference which has a 2 credit worth academically. I did not think the VWP was appropriate for it. The consular officer did not accept it because my country is participating the VWP. In addition, he was very enthusiastic and made an assunmption that I would change a status after entering the US. Now I am in the US after having a serious interrogation at the airport. It seemed like the consular left a message about the interview, seemed very personal, associating with my passport and fingerprints. I was taken to another room. The officers threatened that they could deny and make me deport right away at the room. I anticipate this may happen every time I come to the US. Thank you, |

You cannot change status in VWP. Counselor did not leave a message. They can't. Fingerprinting is now normal for all entrants. Tino

Hi Timo,
I am sorry that I could not check the forum. I've applied for a B2 whereas I should not have since I could trip to the US under the VWP. I applied for a B2 since I had two big conferences and if I would miss them, that meant that I could not finish my degree. At the US embassy, when the counslar rejected giving me a B2 visa, I was very upset and asked him to let me talk other people. That seemed insulting him in turn. He started to make an assumption that I would change my status if I got a visa. And He left the message in the computer system. OK. I had applied to a wrong visa. I did not need any visa to begin with. I flew to the US under the VWP. I am very sure that the consular left a message because at the airport, the homeland security officer check the computer and asked about a detailed conversation I had with the counslar. I had a hard time to come to the US. I was almost sent home. My question is that I have to fly back to US to take another test. Authorization for the test will be expire soon. This time I am staying in the US for about 80days. If the time gap is too short, would that be a problem? Thank you. |

Hmmm.... yeah this is interesting. I did not realize the whole case before.
You are Japanese citizen right? So you can use VWP. So then the question for the immigration officer is "why would you apply for B2 visa?"... probably he can only think of 2 reasons: 1) For some reason you need to be in the USA for longer than 90 days (usually VWP is good for 90 days stay, but B2 can be up to 180 days) BUT, in that case you should probably apply for a different visa anyway, not B-2. 2) You plan to change status in the USA. the reason is that VWP cannot change the status, but B-2 can...... so he thinks, you want B-2 because you will change status in US. The other problem is you are taking the NAPLEX and MPJE, these are tests to become a medical professional in the USA!! So, from the consulars point of view, you are asking for a visa that can chnage status to go to the US to take tests for US jobs..... I think he must reject thy visa. It is very interesting to know that he could leave some remark on your record.... normally there will be no reason. If the officer thinks you are going to immigrate, he just denies the visa... but in Japan you can go VWP, so basically you can go behind him if he denies the visa..... very interesting case. But to your question: You came to the US on VWP, stayed, then are back in Japan now? How long did you stay in Japan after you came back? You can stay in the USA 90 days on VWP..... usually, unless they give you a shorter time when u enter USA, but standard is 90 days. Tino
