This is simply because you are NOT renewing (for whatever reason) your expired passport eventhough you are fully aware of it. Technically speaking, you are in violation of your stay in USA because you would need a valid and unexpired passport to remain in the States. You shall be fine after renewal unless the consular office in the States of your country representive refuse to renew for you. Good luck.
