  3. Hi all, I have been going thru this forum and have seen a lot of expired visa related queries, however I wanted to post again since my situation is a bit different and I need advice. Here’s a little background. I came to the US in 2005 for my Bachelors degree. I graduated in May 2009 and have been working on my OPT ever since. My OPT is valid until November 2011 however my visa expired in November 2009. I understand my legal status in the US is maintained by my I-20 document and EAD, both of which are valid for me. Here’s where my situation gets a little complicated. I am an Indian citizen but my parents live in Indonesia (my dad’s job). I will be traveling to Indonesia next month and I checked with the US Consulate there and found out its possible for me to apply for a visa renewal in Jakarta, Indonesia. My dad has a work related Permanent Residence for Indonesia but I’ve never been to that country. I have all my documents ready (I-20, passport, I-94, EAD card, letter from my university stating that I graduated and am working on my OPT authorization, letter from my employer, pay stubs, letter from my father’s work stating that I’m his dependent, “zero balance” document from my university stating I have paid my tuition in full). My questions are: - Could they reject my F-1 since I have already graduated (even though technically OPT is still student status)? - Does having a job in the US imply I have immigration intent? - Is it rather advisable to get my F-1 renewed in Delhi, India instead? - Is there a difference between visa renewal and visa reapplication? - Could there be any other complications that anyone can predict? These questions may seem repetitive to some, none the less, I am really nervous about it. I’m debating whether it’s really worth traveling back at all. Any kind of help or support is appreciated. Thanks in advance.

    H1 to F1 COS

    Hi , I am currently in the US on an H1B ( Extension) . My visa/I-94 is expiring in the month of September 2011. I plan to go for higher studies ( MBA) this Fall. I have a few questions on the H1 to F1 Change of Status. 1) I have heard that it may take anywhere from 4-6 months to get COS Approved. In that case even if I start my COS processing now and don't get an approval till September (when the H1/I-94 is expiring), so will I be considered out of Status and have to leave the country? My I-20 would be valid from August Beginning. 2) If my COS is applied but pending approval and my I-20 is starting August can I leave my current job starting July and still be considered in status based on the "30 day" period before start of I-20 OR is that only valid if I have an approved COS? Thanks.
  6. Hello Everyone, I have a rather peculiar situation, and any advice of yours will be deeply appreciated. Here is my case. I am currently on H1-B visa status working as an IT consultant for an Indian consulting firm. I was on bench without getting paid and no payroll of course until recently i have been placed on a project to be specific from November. Meanwhile, i applied for a university for master's program, and i have been accepted to a university with full tuition coverage and stipend from Spring 2011. I would like to go back to school, but it will require me to change my status to F1. I know we can file COS without leaving state, but it will generally take 3-6 months which is not an option for me, since i have to be on F1 to accept the financial aid offered by my university. Option two would be to leave the state, and file for F1 from my home country. Here is my question. How will my previous "being on bench w/o payroll" affect the outcome of my F1 stamping? FYI, I will have my recent 3 paystubs but YTD won't be much since i wasn't getting paid before november. Will this be an issue? Or, is it even necessary to show that i was maintaining H1-B status, since i am actually leaving US, and applying for a F1 visa from my home country? Your help will be much appreciated!!
  7. I'm currently working on H1B (came to US from India on F1 visa for my MS and converted to H1 after completing the degree), but I still need to get my H1 stamped. So I'm on H1 status, but I donot have H1 Visa. Now I want to transfer to F1 for starting my Ph.D in about 3 months. Which is a recommended way of transferring my H1 to F1: 1) Should I go back to India after resigning to my job, and apply afresh for an F1 with the I-20 issued by the university? That way I guess I'm free to visit India thereafter, but it might be risky since I've worked on H1 for a couple of years. OR 2) Apply for COS here in US and after it gets approved, join the university and then when I get time, travel to India and get the stamping on my F1 visa? I heard that the 2nd option is much safer though it takes more time, but my question is, if I follow 2nd method, I anyway need to go for the stamping when I visit India during my Ph.D-how risky(or safe) is it to go for F1 stamping once my COS is approved here, compared to applying for it afresh?
  8. i got a b1-b2 visa and a f1 visa approved and stamped into my passport before i came into the us. as i was coming more then thirty days before my course begun i entered on my b1-b1 visa. my course is starting in a week and i was wondering if i can change over to my f1 visa without leaving and re-entering the country ie: change visa status while still in the us? help please thanks
