how many days does one have once their opt ends to either (1) go back to school or (2) get a job 60 days?

I just found out that F1 visa holders can take leave of absence between classes by working with their DSO and filing for a LOA (leave of Absence form). This allows you to stay out of the country without having your F1 visa status being jeapordized. Is this true? What if the student has already left the country, can the student work with the DSO and file for Leave of Absence reportly?

Tino or anyone else? Please any advice? Would it just be simpler to try for B1 or F1 stamping? Thanks

Thanks Tino, Does it look fake because there are no pictures? They have no family here..so they just went to court and got married. Anyway if H4 gets rejected, can he then try for B1 or new F1 stamp after that? Or how about just applying for new F1 stamp to begin with? How much funds will he need to show in bank? Like 1 year's fee or 1 semester's fee?

Thank you for your response, Tino Wife is not from India, she is from the UK. She came to US on F1, graduated, got a job and got H1B. They met in US, dated for a while and then got married. Just 1 week after court marriage, he had to go to India to take care of the emergency situation in India (his dad was ill). He has an expired F1, valid I-20 but wants to transfer to H4. He wants to go back to US now because the emergency situation has been taken of and now he is ready to be re united with his wife. She makes $59,000 a year. Thanks again Tino. My friend, an H1 B visa holder, recently got married to an F1 visa holder here in USA. They were planning to apply for the husband (F1 visa holder)'s H4 visa here in states so he can drop out of school. However, due to some emergency back home, the husband had to go to India. Now the emergency has been taken care of and he wants to come back. We have following questions 1. For H4 visa interview in India, does he still have to show the proof of strong ties in India? 2. Is H4 visa process / interview relatively easier than F1 or B1 visa process? 3. What documents other than his wife's H1 B approval notice and their marriage certificate does he have to take with him to the interview. They had a small ceremony in court here in states so they do not have the wedding pictures and such 4. He is planning to come here on H4, and then his wife (my friend)'s company is planning to file for her I-485. The plan is that she will file for his I-485 as well after he gets here. Does he need to mention this to the counsulate? Will the consulate ask what is he planning to come here and do? because he really plans to just stay home until his I-485 gets approved. My friend graduated with MBA last year and has been on OPT up until now. His OPT is expiring but he doesnt have a job yet. To stay in status, he has decided to go back to school, the only other affordable option in the area he lives is a second MBA program. The question is, is that allowed/legal for one to get a second degree (MBA) in the same area of study?

Thanks Tino - I am asking this question on behalf of my best friend. She was trading with her own money by herself back home. Now she is here in US as a student and wants to invest in forex and trade for herself, while in school. She is an expert in this area. But the question is, when you trade and make profit, technically you are earning "income". F1 students cannot earn income right? So we just want to make sure her status wont be affected if she trades while going to shool.

Is it okay to trade Forex in America with a student visa? - please advise

Hi Tino, I contacted this institute and they said that since the student already has an MBA from US, it will make no sense for him to enroll in an English Course. We will have to look for any other program. Would you know of any other program that is under $25,000 a year in NYC that would provide I-20? Thank you so much

Tino, I need your help urgently. My best friend is currently on OPT and has not secured a job yet. The OPT expires in few weeks. I believe the best option for him would be to go back to school and get an I-20, do you agree? If yes, do you know of any institutes in New York area where he can go for a short course or diploma and get an I-20? Can it be any course? He graduated with MBA last year. The idea is to not to spend a lot of money since he has no job. . Additionally how long can he stay legally in the states with such an arrangement? Thank you so much!

What happens if your OPT expired but your H1B is still pending. Can you stay in country legally and wait for H1B to get approved? Can you renew your OPT? Thank you

My cousin is on OPT and would like to start his own consulting firm with an American Partner. Once the company is set up, can he be sponsored for H1B under that company? Note that it will be a partnership firm between him and his American partner. Thank you!!!

My brother went to public high school in Atlanta and they provided him an I-20 Basically you contact any public school and ask them the process P.S you will still have to pay the fees since you will be Int'l student...approx $5000 a year
