03/22/2008: H-1B Filing for License Required Occupations: USCIS Memorandum of March 21, 2008 Updates AFM Under the H-1B regulation, those who apply for certain occupations that mandate a license to practice for H-1B are normally not eligible for the petition, such as public school teachers, unless the petition accompanies such license. On the other hand, the State Licensing Boards cannot issue a license even if the aliens are qualified unless the aliens are authorized for employment and possess a social security number. Since a social security number cannot be issued unless the alien is authorized to work, these aliens are trapped in "catch-22" situation unless some type of relief is given by one of these three government agencies. In order to untangle this logjam, the legacy INS issued a policy to approve H-1B petition for one year to allow such aliens to apply for a state license. Yesterday, Mr. Donald Neufeld, Deputy Director of Domestic Operations of USCIS issued a memrandum to update the Adjudicators' Field Manual (AFM) to instruct the field (Service Centers) adjudicators to approve such H-1B petitions for one year on the two conditions, among others: The alien submits an evidence of pending license application before the State Licensing Board and files as initial evidence all the documents to establish that the aliens are eligible for the license but for the employment authorization and social security number requirement. Release of this memorandum and updating of AFM are very timely for these professionals to file FY 2009 H-1B cap petitions on April 1, 2008.

Download the Extended Intern Application from Tx state Board of pharmacy and send it to them. Upon approval you could register for the NAPLEX and MPJE. Hope it helps.

Just wanted to clear a couple of things about Tx Internship. 1) You can start your internship as soon as you get your FPGEC certificate and not work more than 3 months before you take your NAPLEX and MPJE. Complete your NAPLEX and MPJE and finish your remaining hrs. 2) Take your NAPLEX and MPJE and then begin internship. I see a lot of people going for the second option. And yes, you need the FPGEC certificate to take the NAPLEX and MPJE

Say you want to get employed in an hospital which is affiliated to an institute of higher learning, in which case it most likely is a non profit organization, then you do not come under the numerical cap of visas given out every year. Here you could be sponsored for an H1 anytime of the year. For an example, most of the University Hospitals are not for profit org's. Hope it helps. Indospurfan

Hi Knok, I was sponsored by Walgreens but was not selected in the lottery. :hmm: Since I am in Texas. I completed my NAPLEX and MPJE and am nearing completion of my intern hours in a hospital pharmacy which is a not- for -profit org. The Org's do not come under the usual cap. So you can see that I just moved on.

Hi, You don't need a Texas intern Permit to apply for the NAPLEX. You need to clear both the NAPLEX and MPJE to and then apply for a Texas intern permit. Hope this helps Indospurfan

Hi, You need to complete the NAPLEX and MPJE before being considered for internship in Texas. You can take the NAPLEX and MPJE without a SSN. YoU could call the TSBP, and speak to LISA AKE, the Intern Coordinator, at 512-305-8011 and request applications for the NAPLEX and MPJE. You can tell her that you dont have a SSN and she'll advise you what to do. Hope this helps.

Hi, You need to clear your NAPLEX and MPJE before you start your internship in Texas or if you have a work permit and start internship immediately after getting the FPGEC certificate you can work only for 3 months after which you need to take your NAPLEX and MPJE. You can applyfor the NAPLEX and MPJE without an SSN stating that you dont have one because you are on such and such a visa. Hope it helps.
